Legal Custody (sole or joint)

Legal custody refers to who has authority to make decisions for the minor children concerning education, health and religious issues.

 

Legal custody affords a parent the right and obligation to make long range decisions involving education, religious training, discipline, medical care, and other matters of major significance concerning the child's life and welfare.

 

A joint legal custody arrangement is based upon the capacity of the parents to communicate and to reach shared decisions affecting the child's welfare.

Physical custody involves the right and obligation to provide a home for the minor child.  As such, this right and obligation includes making the day-to-day decisions required during the time that the minor child is actually with the parent having such custody.
